Terms of Service

Welcome to Cineriah — a studio for making films with AI and a theater for releasing them. These Terms of Service are the agreement between you and Cineriah LLC, a Texas limited liability company that operates Cineriah (“we”, “us”), and they govern your use of the service. By creating an account, buying credits, backing a campaign, or watching a film here, you agree to them. Please read them; they cover real money and real rights.
1. Who can use Cineriah
You must be at least 13 years old to use Cineriah, and at least 18 (or the age of majority where you live) to purchase credits or subscriptions, buy tickets, pledge to a campaign, or receive payouts. By using the service you confirm this is true. You are responsible for your account and for keeping its sign-in method secure.
2. Your account
Accounts are created and authenticated through our sign-in provider. You agree to give accurate information and to keep it current. We may suspend or close accounts that violate these Terms. You may stop using the service at any time; some records (for example, purchase and payout records) are retained as described in the Privacy Policy.
3. Your content and your films
You keep ownership of what you make. The screenplays you write, the actors, storyboards, scenes, and films you generate, and anything you upload (photos, video, motion recordings) remain yours. You grant us the license we need to operate the service: to host, store, process, display, and distribute your content within Cineriah — for example, showing your published film in the Theater, your campaign on the Crowdfund page, and processing your uploads through the AI providers that power generation.
We do not use your content to train our own AI models. Generation requests are fulfilled by third-party AI providers under their own terms; we send them only what is needed to fulfill your request.
You are responsible for the content you create, upload, and publish. Only upload material you have the right to use — including photos of real people, which you must have permission to use.
Your screenplays are portable. Screenplay export — as a formatted PDF and as a Fountain plain-text file — is available on every plan, free of charge and without watermarks. If your subscription lapses or is cancelled, you can still view your screenplays and export them in both formats.
4. AI-generated content
Films and images you generate on Cineriah are yours to use, including commercially, subject to these Terms and to the acceptable-use rules below. AI outputs can resemble other works or people unintentionally; you are responsible for reviewing your outputs before publishing them and for how you use them outside the service.
5. Acceptable use
You agree not to use Cineriah to create, upload, or publish content that:
- is illegal, or promotes illegal activity;
- sexualizes minors in any way, real or generated — zero tolerance;
- impersonates a real person without their consent, including deceptive deepfakes of real people;
- infringes someone else's copyright, trademark, or other rights;
- harasses, threatens, or incites violence against anyone;
- is malware, spam, or an attempt to break, overload, or abuse the service.
You also agree not to resell access to the service, scrape it, reverse-engineer it, or use it to build a competing dataset.
6. Reporting and takedown
Anyone can report a published film or campaign using the Report control on its page. We review reports and may remove or unpublish content that violates these Terms, restrict the account that published it, or both — at our discretion and without prior notice where the violation is serious. We may also suspend generation features for accounts that abuse them.
7. Credits
Generation on Cineriah costs credits. Credits are a prepaid service allowance, not money: they have no cash value, are not transferable, and cannot be exchanged for cash except where a refund is expressly provided by our Refund Policy or required by law. Purchased credit packs do not expire while your account is open. Subscription credits are granted monthly and do not roll over. If a generation fails, the credits it reserved are returned to your balance automatically.
8. Subscriptions and purchases
Subscriptions renew automatically (monthly or yearly, per your plan) until you cancel in your account settings; cancellation stops future renewals. Prices are shown before you pay and may change with notice — changes apply from your next renewal. Payments are processed by Stripe; we never see or store your full card details. Purchases are subject to our Refund Policy. Prices may not include sales tax, VAT, or similar taxes; where we are required to collect them, they are added at checkout, and you are responsible for any taxes that apply to you.
9. Tickets and the Theater
Published films can be watched by buying a ticket at the price the creator set. Tickets unlock viewing within Cineriah; they are not a download or a transfer of rights in the film. If a film is removed after you bought a ticket and you have not been able to watch it, contact us and we will make it right per the Refund Policy.
10. Crowdfunding — for backers
Campaigns on Cineriah let you pledge money to help a creator make a film. Please understand what a pledge is: a pledge is support for a creative project, not a purchase of a finished product and not an investment. You are not acquiring equity, revenue share, or ownership of the film.
Cineriah is the platform, not the producer. We verify creator identity before they can publish a campaign and we operate the payment rails, but we do not guarantee that a funded film will be completed, match its pitch, or be delivered by any date. If a creator fails to make a good-faith effort to complete a funded project, they are in breach of these Terms — we may remove their campaigns, withhold future payouts, and restrict their account, and we may facilitate refunds where funds remain available, but we are not obligated to refund pledges from our own funds.
Pledges are charged immediately when made. See the Refund Policy for when a pledge can be refunded.
11. Crowdfunding and earnings — for creators
To publish a campaign or receive money you must complete identity verification through our payment partner (Stripe). By publishing a campaign you make a commitment to your backers: use the funds to make a good-faith effort to complete the film substantially as pitched, keep backers reasonably informed, and deliver what your campaign promised or explain honestly why you cannot.
Creator earnings (from tickets and campaigns) accrue to your Cineriah balance after the platform fee shown at the time of sale. Payouts go to your connected Stripe account. Earnings connected to refunded or disputed payments are held or reversed; we may withhold payouts while a dispute, refund, or Terms investigation is open.
12. Third-party services
The service is built on third-party providers — payment processing (Stripe), sign-in, hosting, storage, and AI generation providers. Their processing of your data is described in our Privacy Policy. We are not responsible for third-party services we do not control, but we choose providers carefully.
13. Copyright complaints
If you believe content on Cineriah infringes your copyright, email support@cineriah.com with: your contact details, the work you believe is infringed, the URL of the content, a statement that you believe the use is unauthorized, and a statement, under penalty of perjury, that your notice is accurate and you are the rights holder or authorized to act for them. We remove infringing content and may terminate repeat infringers' accounts.
14. Disclaimers
Cineriah is provided "as is." We do not warrant that the service will be uninterrupted or error-free, that generations will match your expectations, or that any film will earn money. AI generation is probabilistic — results vary. To the fullest extent permitted by law, we disclaim all implied warranties.
15. Limitation of liability
To the fullest extent permitted by law, Cineriah will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill. Our total liability for any claim is limited to the greater of the amount you paid us in the twelve months before the claim or $100. Some jurisdictions do not allow these limits, so they may not fully apply to you.
16. Indemnification
If your content, your campaign, or your breach of these Terms gets us sued or fined — for example, you published a film using someone else's work without permission, or you took backers' money and misused it — you agree to cover the costs, damages, and reasonable legal fees we incur as a result. This does not apply to the extent a claim results from our own breach of these Terms or our own misconduct.
17. Termination
You can close your account at any time. We may suspend or terminate accounts that violate these Terms. On termination your right to use the service ends; sections that by their nature should survive (ownership, payment records, disclaimers, liability limits, disputes) survive. If you have an unpaid creator balance and your account is in good standing, we will pay it out per the payout rules before closure.
18. Disputes and governing law
If something goes wrong, contact us first — most issues can be fixed by a human within a few days. These Terms are governed by the laws of the State of Texas, United States, without regard to conflict-of-law rules, and disputes will be resolved in the state or federal courts located in Travis County, Texas, unless applicable consumer law gives you the right to your local courts.
19. General
You may not transfer this agreement or your account to someone else without our consent; we may transfer it as part of a merger, acquisition, or sale of the service. If any part of these Terms is found unenforceable, the rest still applies. We are not responsible for delays or failures caused by events outside our reasonable control (outages of our providers, natural disasters, and the like). You agree to comply with applicable export and sanctions laws when using the service. These Terms, together with the Privacy Policy and Refund Policy, are the entire agreement between you and Cineriah LLC about the service.
20. Changes to these Terms
We may update these Terms as the product evolves. For material changes we will give notice (for example, in-app or by email) before they take effect. Continuing to use the service after changes take effect means you accept them.
